Telecommunications Company Obtains Dismissal of Employment Complaint

Lash & Goldberg LLP and its co-counsel obtained a dismissal in federal court, with prejudice, of an employee’s complaint to recover benefits under the Employee Retirement Income Security Act (ERISA) against a telecommunications company and its in-house counsel. The employee previously had asserted similar claims in a separate lawsuit and had released those claims as part of a negotiated settlement of that lawsuit.  After considering the company’s motion to dismiss, the court agreed with the defendants’ argument that the claims were barred by the doctrines of waiver and release and res judicata.
