Rachel Elizabeth Kaufman is a senior associate in Lash & Goldberg LLP's Miami office. Rachel represents clients in a variety of sophisticated business litigation matters.  Her business litigation experience involves complex commercial transactions, large contract disputes, employment matters, class actions, securities, antitrust and health care operations and litigation.

In conjunction with her business litigation practice, Rachel advises health care clients regarding the litigation issues and nuances unique to the health care industry. Rachel’s health care experience includes medical staff and peer review matters, as well as Joint Commission and state and federal regulatory compliance. She also represents clients in government investigations relating to health care fraud and abuse, and defending False Claims Act cases. She previously practiced as a business and health care litigator at a large Washington D.C. based law firm.

Rachel earned her law degree from the Boston University School of Law where she was also a staff editor for the American Journal of Law and Medicine. She received her Bachelor of Science Degree from Northwestern University where she majored in Communications and Philosophy.

  • Participated in obtaining a summary judgment for a national health system in a federal breach of contract dispute involving alleged HIPAA violations and damages of more than $500 million
  • Participated in representing the Medical Executive Committee of a hospital affiliated with a national health system in a peer review hearing
  • Participated in obtaining a summary judgment for a hospital affiliated with a national health system in a physician’s multimillion dollar federal court discrimination lawsuit, and obtaining an affirmance on appeal before the Eleventh Circuit Court of Appeals
  • Participated in obtaining a summary judgment for a hospital affiliated with a national health system in a breach of contract lawsuit involving a physician’s professional association, and defeated the professional association’s counterclaim
  • Participated in obtaining an $8 million final arbitration award for a non-profit hospital against an affiliate of a multinational pharmaceutical conglomerate and defeated the affiliate’s $43 million counterclaim, all of which was confirmed by a federal district court
