Martin Goldberg is a
trial lawyer representing clients in high stakes litigation in Florida and
across the country. Mr. Goldberg was recently selected as one of South
Florida’s “Most Effective Lawyers” in 2012 by the Daily Business Review,
for his work in the successful defense of a Florida not-for-profit hospital in
arbitration against a multi-billion dollar pharmaceutical conglomerate, an
honor he shares with two of his partners. The case involved the delivery of
cancer treatment services with alleged damages against the hospital in excess
of $40 million, yet resulted in a $9 million award for the hospital after a
three week trial. He is also one of a small number of lawyers voted nationally
by his peers for current inclusion in The Best Lawyers In America® in three
different categories - Commercial Litigation, Health Care Law and Criminal
Defense: White Collar. He has been repeatedly recognized as one of the
"Top Lawyers in South Florida," according to the South Florida
Legal Guide, and listed in Florida's Legal Elite and Florida’s
Super Lawyers. He has also received the highest rating (AV Preeminent) in

Education
and Professional Background
A native of Washington
D.C., Mr. Goldberg graduated cum laude from the University of Maryland
with a degree in Accounting and became a Certified Public Accountant. At
Maryland, he was selected as the University’s Outstanding Male Undergraduate,
and later recognized as the University’s first ever Outstanding Young Alumnus
for his professional achievements. Mr. Goldberg earned his law degree cum
laude from Georgetown University Law Center and came to South Florida to
serve as a Law Clerk to United States District Court Judge Sidney M. Aronovitz.
He then entered the United States Attorney’s Office for the Southern District
of Florida and served as an Assistant United States Attorney where he tried
more than 35 cases to verdict, argued numerous appeals before the United States
Court of Appeals for the Eleventh Circuit and was honored by the Department of
Justice with its Director’s Award for superior performance as a trial attorney,
presented by the United States Attorney General.

and media leader in world-wide talent representation in various breach of
contract, Lanham Act and tort actions, including the individual representation
of high profile sports and media personalities; (c) Representing a national
healthcare system, a Florida hospital and a prominent physician corporation in
the defense of separate qui tam investigations and federal lawsuits
alleging violations of the False Claims Act and healthcare compliance

including exclusive and hospital based contracting, hospital bylaws; tortuous
interference with alleged referral patterns and economic interests; peer review
and staff privileging; licensure proceedings; managed care disputes; compliance
with surveys and inquires by the Joint Commission, Center for Medicare and
Medicaid Services, Florida Agency for Health Care Administration and other
regulatory bodies.
White-Collar/Regulatory
Mr. Goldberg manages and
resolves parallel criminal and civil investigations, and post-indictment proceedings.
He has coordinated the defense of corporations involved in grand jury
investigations, and has represented key corporate executives of numerous
Fortune 500 companies both at the grand jury stage and after indictment.
Illustrative representations include defending the former City of Miami Police
Chief and City Manager against federal corruption and fraud charges; defending
another Miami government official charged with theft of federal funds; and
successfully defending at trial a state and federal law enforcement agent
charged with federal mail fraud. Mr. Goldberg was Board Certified in Criminal
Law by the Florida Bar.
Independent
Work/Arbitrator
Mr. Goldberg also serves
as an independent counsel and arbitrator. For example, in 2009 he was retained
as an Independent Counsel by a South Florida Governmental Hospital District to
conduct an investigation into possible ethical and other wrongdoing of a
Commissioner appointed by the Governor of Florida, and prepared and presented a
voluminous report to the District which was then sent to the Governor. Mr.
Goldberg also serves as an arbitrator for healthcare disputes for the American
Health Lawyers Association, and recently concluded a complex case in Puerto
Rico over a number of months in 2012.
